These Terms of Service ("Terms") govern your use of the website www.trypuravia.com (the "Website") and any purchase made through it. The Website and the Puravia brand are operated by Puravia LLC, a limited liability company formed in the State of New York, United States, with its principal place of business at 167 Madison Ave, Suite 205, New York, NY 10016, United States ("Puravia", "we", "us" or "our").
By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. Eligibility
You must be at least 18 years old, or the age of majority in your place of residence, to place an order. By placing an order, you confirm that the information you provide is accurate and complete.
2. Products and Descriptions
We make every effort to display our products, colours and descriptions as accurately as possible. Colours may vary slightly depending on your screen. Our products are cosmetic products for external use only, they are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Results vary from person to person. Please read the label and usage instructions before use, and perform a patch test if you have sensitive skin or known allergies. Check the ingredient list before use. All products are subject to availability, and we reserve the right to discontinue or modify any product at any time.
3. Prices and Currencies
Prices are displayed in the currency selected for your region and include any applicable taxes where required by law. Where prices are converted from our base currency, the final amount charged may vary slightly due to exchange rates applied by your bank or card issuer. Shipping costs, if any, are shown at checkout before you confirm payment. We reserve the right to correct any pricing error, including after an order has been placed; in that case, we will contact you and you may cancel the order for a full refund.
4. Orders and Contract Formation
Your order constitutes an offer to purchase. The contract between you and Puravia LLC is formed when we send you an order confirmation email. We may refuse or cancel an order in cases of suspected fraud, unauthorised payment, pricing error or product unavailability. If an order is cancelled after payment, you will be refunded in full.
5. Payment
Payment is taken at the time of your order through our secure checkout and third-party payment processors. We do not store your full card details. By submitting payment, you confirm that you are authorised to use the chosen payment method. Your bank statement may show a descriptor referring to Puravia or Puravia LLC.
6. Shipping and Delivery
Processing times, delivery estimates and shipping conditions are described in our Shipping Policy. Delivery times are estimates and are not guaranteed. Risk of loss passes to you upon delivery to the address you provided. You are responsible for providing a complete and accurate shipping address.
7. Returns, Satisfaction Guarantee and Refunds
Our 60-day satisfaction guarantee, your statutory right of withdrawal and the conditions for refunds are set out in our Refund Policy, which forms part of these Terms. Nothing in these Terms limits the statutory rights you have as a consumer under the laws of your country of residence.
8. Payment Disputes and Chargebacks
If you have a problem with your order, please contact us first at contact@trypuravia.com. We respond within 24 to 48 hours (Monday to Friday) and will do our best to resolve the issue quickly, whether by replacement or refund in accordance with our Refund Policy. Initiating a chargeback without first contacting us does not speed up resolution. Where a chargeback is filed, we reserve the right to provide your order details, delivery confirmation and correspondence to the payment processor in order to respond to the dispute.
9. Intellectual Property
All content on the Website, including text, images, logos, videos and product descriptions, is the property of Puravia LLC or used under licence, and is protected by intellectual property laws. The Puravia name and logo are trademarks of Puravia LLC. No content may be reproduced or used without our prior written consent.
10. Use of the Website
You agree not to use the Website for any unlawful purpose, not to attempt to gain unauthorised access to our systems, and not to interfere with the proper functioning of the Website. We may suspend or restrict access to the Website at any time.
11. Reviews and Communications
If you submit a review, comment or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display it in connection with our business. Content must not be unlawful, misleading or offensive. We may remove any content at our discretion.
12. Limitation of Liability
To the fullest extent permitted by law, Puravia LLC shall not be liable for any indirect, incidental or consequential loss arising from the use of the Website or our products. Our total liability in connection with any order shall not exceed the amount paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
13. Privacy
Your personal information is processed in accordance with our Privacy Policy.
14. Governing Law
These Terms are governed by the laws of the State of New York, United States. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of that country where the law allows.
15. Changes to These Terms
We may update these Terms from time to time. The version in force at the time of your order applies to that order.
